What Is Notary E&O Insurance?

Errors and Omissions insurance protects you if a client or third party claims that your notarial act contained an error that caused them financial harm. It covers your legal defence costs and any damages awarded up to your policy limit. Without it, a single disputed signing could expose your personal assets to significant liability.

Do You Really Need It?

Technically, E&O insurance is not required by law in most states. Practically, however, most title companies and signing platforms require proof of E&O coverage before assigning you any work. Even if you work entirely with direct clients who do not require it, the liability exposure of operating without coverage simply is not worth the annual premium savings of a few hundred dollars.

How Much Coverage Do You Need?

Standard coverage amounts are $25,000, $50,000, and $100,000 per occurrence. Most title companies require a minimum of $25,000. We recommend $100,000 for signing agents handling regular loan packages — the premium difference between $25,000 and $100,000 in coverage is typically only $40-$80 per year, making the additional protection very cost-effective.

Where to Get It

The NNA offers E&O policies specifically designed for notary signing agents. Other providers include specialty carriers like NotaryPro Insurance and standard small business insurers. Compare at least two quotes — rates and coverage terms vary significantly between providers, so shopping around saves meaningful money.
